Overview
XPOSED respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
Copyright Infringement
If you believe that any content appearing on our website infringes your copyright, please send a written notification to our designated copyright agent containing the information detailed below. XPOSED will process and investigate notices of alleged infringement and take appropriate actions under the DMCA and other applicable intellectual property laws.
How to Report Claimed Infringement
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):
DMCA Notice Requirements
1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works. 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. 4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address. 5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
DMCA Procedure
Upon receipt of a compliant DMCA notice, XPOSED will expeditiously remove or disable access to the allegedly infringing content and notify the alleged infringer. The alleged infringer may then submit a counter-notification if they believe the content was removed as a result of mistake or misidentification.
Counter-Notification
If you believe your content was removed due to a mistake or misidentification, you may submit a counter-notification to our designated copyright agent. Upon receipt of a valid counter-notification, XPOSED will provide a copy to the original complainant and wait 10-14 business days before restoring the content, unless our copyright agent receives notification that a legal action has been filed seeking a court order to restrain you from engaging in the allegedly infringing activity.
Counter-Notice Requirements
1. Your physical or electronic signature. 2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. 3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification. 4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which XPOSED may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
Repeat Infringer Policy
In accordance with the DMCA, XPOSED maintains a policy to terminate access for users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity multiple times and/or has had content removed from our service multiple times.
False Claims
Misrepresentations in DMCA notices or counter-notices may result in liability for damages, including costs and attorneys' fees incurred by XPOSED or other parties. If you are unsure whether content infringes your copyrights, please consult with a legal advisor before filing a DMCA notice.
